Legal Representation For ERISA

In 1974, the U.S. Congress passed the Employee Retirement Income Security Act (ERISA) to provide protections for many workers covered by employer pensions and health care plans. ERISA establishes minimum standards employers and plan administrators must follow to ensure proper financial protections for the workers voluntarily participating-whether they are involved with a Union or not.

As an experienced labor law and ERISA claims attorney in Chicago, I have been advising and representing plan sponsors, employers and individual workers on ERISA litigation matters in Illinois for more than 20 years.

My experience as plaintiff and defense lawyer in ERISA law includes litigation related to:

  • Failure to meet fiduciary responsibilities regarding operating the pension plan exclusively for the benefit of the participants
  • Misappropriation of plan assets for the benefit of the plan administrator or sponsor
  • Improper asset valuation
  • Failure to hold plan assets in trust for exclusive purpose of property distribution to qualified participants
  • Inappropriate selection and monitoring of plan service providers
  • Workplace retaliation (wrongful discharge, harassment or discrimination) against a plan participant for exercising rights under the plan
  • Failure to comply with ERISA provisions as they relate to the Affordable Care Act

I also represent plan participants in cases involving employee benefits, denied disability claims and appeals.

If you are an employer, sponsor, administrator or plan participant needing legal assistance regarding a pension or health care plan governed by ERISA, call my office in Chicago at 312-767-4596 or send an email requesting an opportunity to discuss your circumstances.
